Max, regarding the session on "MAINSTREAMING HUMAN RIGHTS IN THE WORK OF THE IG," I was particularly interested with A2K and Human Rights. I am an educator and I am an advocate of free access to educational resources. I think the main contention in this particular issue is about adapting a rights-based approach. Should we look into this issue at a "country" perspective?

Most developing countries like the Philippines have few IP laws - mostly bordering on media piracy with very little focus on educational/scientific data protection. Plus, there is less competition on this aspect within developing countries compared to developed countries so access to such data would be easier.

On the other hand, developing countries are left in the dark and do lag behind in research. One particular instance is during a research activity of mine on successful e-commerce projects for developing countries, I was looking for relevant data on statistics of e-commerce projects in the MENA region. I was directed to one site (after several attempts of searching online) that has this relevant statistic and only to find out after reading the summary that I was required to pay to access a very short data, as it was copyrighted and all. I was disgusted as I had thought that such information should be made public. I emailed the site about requesting access for a research work and appealed if I should just be allowed to view it for free as I would also acknowledge the author and publisher. They responded again and I told that they cannot divulge the information until I pay, saying it was copyrighted. I got the same machine generated reply. Now that put me at a dead end and gave me more reason to curse.

So what happens now is that the pressure on the rights-based approach is more meaningful to countries with stricter IP laws? Who should be given more precedence in the rights-based approach? The users or creators of such data? These are questions I had wanted concrete answers. Or maybe I just missed those?

But then I knew this issue with regards to A2K has been more on restrictions due to IP laws. During the OECD Ministerial Meeting and CS Forum last June 2008, it was declared by the CS that:

Promotion of Access to Knowledge: We support open access to government-funded scientific and scholarly works and endorse the OECD Principles and Guidelines for Access to Research Data. We support the OECD Recommendation for Enhanced Access and More Effective Use of Public Information. OECD countries should oppose extensions of copyright terms and private ownership of essential knowledge and cultural information that can be made available on the Internet. We recommend that the OECD undertake a study on the importance of copyright exceptions for education, libraries and archives, the disability community, and new innovative services. "

There is a limitation to this declaration though - it says OECD countries. Then again, what happens to those countries who are not members of OECD? That is why I was particularly engrossed with the rights-based approach taking into a country perspective in these cases.

Please do correct me if I am wrong in my assumptions. :)

I attended the forum on internet bill of rights but the discussion was not substantial. in fact, during the forum there were more questions than answers or solution to the proposition. when we talk of internet bill of rights do the rights refer to the internet or the internet users?

I attended two sessions on the Bill of Rights but as I was always catching with other sessions I was late and would get lost in the discussions. Just bits and pieces here and there. I would love to read session materials. Are there any written reports about the sessions during the IGF? Thanks.
